Wow. I mean I'm not defending the perp and it sucks that people parished in the crash, but I'm just shocked that the perp would be charged for such an indirect effect of his actions. I could see if he caused a traffic accident, but in the air? I don't know. I guess that's why you're the cop and I'm not. :bigwink:

the thing is he was the cause of the deaths. that's the theory of proximate cause. they wouldn't have been up there chasing him except for his actions.

But couldn't it be said that, while it's the job of the news choppers to report news, they shouldn't have been chasing down the news? A police chopper should've been the only ones chasing the action by air, methinks. The police are the only ones IMO who HAVE to be in such a situation. With that said, could the same hold true in this hypothetical: A driver is pulled over and given a field sobriety test. In the the passing traffic, a 'rubber necker' turns his attention away from the road for a split second to see what going on and hits the car in front of him cause it slowed for the same reason, causing injuries to one or more people involved. Now, could either parties involved in the accident hold the pulled over driver accountable for injuries/damage?

the rubbernecker is solely liable. can he be sued? sure. everyone can be sued in the civil court these days. that's why we need tort reform. (Hi Construct:D) but the news choppers were doing their jobs. they were required to be up there.

Well if the perp in the car wasn't running from the police the choppers wouldn't have been up there in the first place.

I found it sick that other news choppers were up there filming and broadcasting footage of the burning wreckage of their news colleagues mere moments after the crash

Journalists are trained to report news, neutrally and unemotionally.  That news can be happy or sad.  They have to report the facts, as they happen.  In some instances their human nature will be crying out to help the victims .....they can't, that is not part of the job.

I can't believe the perp will be charged in this manner!!  It's absure, frankly.  Not to take away from the tragedy of the deaths of those in the helicopters, but we all make decisions every day; why blame others for those choices?
