I was told by the owner of a gun shop this week that you need to "warn" an intruder IN YOUR HOME that you have a gun, and that you will protect yourself! Otherwise, the legal action will most likely be against the home owner!  Now I ask you.................If someone breaks into your home, do you feel you need to warn them that you will protect yourself? Do you want to give THEM the advantage of letting them know you have a gun? I say if you shoot to kill................who's going to tell the police you DIDN'T warn them? Since when does the intruder have rights?

shoot their sorry butts outside, drag them inside, and say you were 'in fear for your life'. ..besides, i thought those ordinances were defunct. i don't think you have a duty to retreat in most jurisdictions anymore. Last edited on 04:01 am by Lady Cop  |

The laws in each state are different, Fox. I was discussing what would happen if I ever had to shoot an intruder in my home with someone who knows guns and the law. First off, I agree with JBF. If the son of a bitch is dead, he can't tell anyone whether or not you warned him. Which I think is a crock. We're not cops, we shouldn't have to give warning. Not in our homes. Once, some years ago, I deterred an intruder by racking a shell into my shotgun. That was all the warning the man needed. I lived in an area worse than I live in now and was prepared to kill the burglar. The distinctive sound of a shotgun racking is all some need, thankfully. BUT....if you are in a position where you are going to take someone out for trying to break in, UNLOAD your weapon. Kill the bastard, and keep shooting. Fire into the walls, (as long as you know the bullet won't travel and kill an innocent) fire into the floor, fire into the ceiling. When the cops show up and there is a dead man in your house with a single round fired that hit him between the eyes from 20 paces, they're going to wonder. If you empty the gun wildly and go into hysterics, the self-defense or home-defense becomes more plausible.

i think a citizen should go online and explore the statutes in their states. it's true, they vary. a few years ago in florida a law was passed you don't even have to retreat in the street! people predicted a bloodbath by crazed gun-owners, it never happened.

LC this is what I have heard you should do, just make sure there butts are inside..

It's interesting how the States do differ. I was told many years ago to do just what LC said. Make sure they're inside when the cops get there! Now, the gun shop owner told me if you do that, the cops will know you shot them outside and drug them in............then YOUR sorry ass will go to jail! He also agrees that if the person is dead, there's no one to say you didn't warn them! He also told me to "empty my gun" just like UTR says. You want to show you were really scared and firing out of fear for your life! So..............I guess a shot between the eyes IS DEFENATLY a no no! (Not that I could DO a shot between the eyes). It is a good idea for people to get familiar with the laws of their state! Not so you don't shoot to kill, but so you know how to cover your ass when you do! By the way....................JBF is the only guy in this conversation...............interesting!

You say "not that I could do a shot between the eyes" but you would be surprised, Fox. The training can kick in when you need it. You-know-who is great with a gun and his shot was with a 9mm, from 40 feet away, in the total dark of un-lit Detroit streets and the guy still died. Keeping that situation in mind, always remember, if they want to arrest you, even if it was self-defense, they will arrest you AND charge you. Even if it's a bullshit charge. And don't go by what we tell you, or some gun-shop owner tells you. Do your own research and KNOW what the laws are. The "must flee" crap has been eliminated in many states. In mine, 26 days too late to make a difference.

I still think no matter what the law................in your home if you kill them, you have a better chance than some where else. Self defense would come first in the thought process no matter what the consequence. I don't think at the time anyone is really going to try and go by the law.
