So today was supposed to be payday at work.  The pay boss (Doc's wife) split before I got my check.  I asked other employees if they have any trouble getting their pay and the answer I got is ALWAYS.  One guy was made to wait a whole week before he got his check!!

Now, I am not a tactful person at all.  And I can't use any of my friends to go threaten the boss because I want to keep my job.  But I'm not used to having to hunt down the boss and ask, beg, plead for money I have earned.  Another co-worker said they were actually told "we're broke" when hassling to get their paycheck.  I personally heard Doc tell someone the clinic is clearing $2,000 a DAY, so I don't buy this "we're broke" crap.  And to be honest, I don't give a rat's ass about any financial issues; real or lied about.  I am not asking for a loan, I am not stealing, I am working for my money.  I should not have to wait.  In fact, when I was managing the bar, I sought employees out to give them their money before they had the chance to ask.

Without having to resort to threatening the boss, what would you suggest I do to nip this in the bud now, and prevent having to deal with this crap in the future?  I can be blunt and mean and take swings at people, but I know nothing about tact.

HELP!!!  Suggestions, please!

Been there done that. Setting precedent is key. Ideally more than one employee (you) would make the effort, ask for a meeting, etc. but either way, I promise you if they get away with it this time they will do it again. Odds are you are faced with a choice - deal with it and suck it up because you like this job, or take a serious chance and getting let go for being a "problem." This is why more than one employee joining in the effort is key - it significantly minimizes that risk. I assume that you signed on with the understanding that you can rely on paychecks, so if they are going to change that understanding, perhaps you insist that it not be unilateral on their part because you don't appreciate the stress and aggravation of worrying about your paycheck, and you don't need another job - collections.

that's bloody outrageous!

they expect you to be reliable, and should meet your expectation of a regular paycheck. i can barely believe it! i would ascribe that to some fly-by-night employer, but not a vet clinic.

i'd tell him i will drop a dime to whatever organization oversees such things in your state, as in, is he paying workers comp or SS for employees? then. on my way to my next job, i'd leave him a lasting gift...reporting his sorry ass to the IRS in case they may want to audit him. :giantgrin:

Absolutely I will set precedent.  I don't really give a crap about the other employees problems, either.  I have all the usual bills any person has, plus a lawyer to pay for and a husband who needs money and only makes 30 bucks a month at his job in the prison.  I don't need a "united front", and I will stand up for what is right.  Tomorrow when I go back in.

LC, that would be the Labor Board and I'd drop a dime on them in a heartbeat if they think they're going to f**k me over like this.  I just have to remember to approach this with diplomacy and tact.  At first.  If I get any shit, the gloves come off.

Another oddity.....I have never written down my SS# for the payroll boss or filled out the paperwork any new employer has you fill out for taxes.  Another puzzle......

WHAT ARE YOU, SOME DAY-LABOR TOMATO-PICKER? i guess you need to find out if he is exempt for some reason. are you an independent contractor responsible for your own SS and workers comp?

No kidding.  The very last thing in the world I need right now is to get mixed up in some illegal crap going on!!!  If I find out that is what's happening there, I will walk, no matter how much I like my job.  Something like that could so easily jeopardize Bullet's appeal and I would die before I'd do that.

I had a similar situation about 25 years ago, although it wasn't that I didn't get paid but didn't get what I was promised. I fought for a few months and then left.

Given the situation and your desire to make an attempt to avoid a blow-up and/or legal I'd appeal to the human side of your boss and approach him with "my utility bills are past due and my electric about to be cut off" or "my car insurance is due and if I don't pay it by such and such a date I'm going to lose the car" or something similar.

If that doesn't work then you might have to go the hard nose route and risk losing the job.

You could tell you boss, that you have a landlord that collects rent from you weekly, and he gets extremely nasty if you're late with your weekly rent. So you really need your weekly paycheck regularly, so you can pay your weekly rent on time!!! ::wiseman::

I agree with Frank -

You may not care about the other employees problems -- but you DO want to avoid having the boss (or worse yet, his WIFE) be able to "play" you as a troublemaker -- that could end up being worse for Bullet than anything else!!

People who will do that kind of crap to their employees often KNOW that they are doing that, and are already willing to defend it, deny it, make it appear that it isn't what it is, etc...

So you NEED numbers on your side to ensure that they can't do the "she said - he said" game--


Another thing-- you're NOT involved in anything illegal so far as goes getting paid without withholding for SS and so on -- that's PERFECTLY legal.

UNTIL -- you or your employer don't  REPORT it correctly to the IRS at the end of the year. THAT is when it's a problem.

Like Frank, I had a startup small business employer do that-- he was new to owning his own business, but not to computers- so he meant well.
But he didn't get with his accountant and set up all the employee withholding and the W-2 forms and all that.
So he was giving me checks.

Tax time rolls around -- and I have to PAY all that tax he would have been withholding.
SS is no problem -- you don't HAVE to contribute, as I understand it-- you just don't get credit for working, that's all.

But the tax thing REALLY sucked--- I ended up paying more than $5,000 in taxes, because I didn't know he hadn't been witholding anything-

I ended up being a 'contractor' to him that year-- acting as if I was a small business myself, and hired my own accountant to deal with the mess. I ended up having to try to claim my tools, my vehicle, lots of mileage, tons of crap, paid the accountant big $$$, and STILL paid a lot of taxes.


So it can be fixed-- but that's the HUGE problem you face if you've been paid a significant amount by these people without proper withholding.

As I said -- it is NOT, repeat NOT illegal. Until you don't pay taxes on it.
THEN Bullet and you might have something to worry about--- but not until you mess with the IRS on April 15th of next year. Til then, it's just a big tax bill you're winding up.

And they don't have to pay it -- YOU DO --- you earned it, you owe the taxes.
Employers SHOULD take it out of your paycheck -- but they don't HAVE to- they can tell you you are a contract employee and responsible for your own taxes.
99% of employers obviously DO that -- there are big tax amounts for them as well--- that employer of mine lost a lot of money too, somehow.
But it wasn't illegal -- just a BIG mess come tax time.

I don't know where you got that, sirlamre, but you are incorrect (former HR professional here). Employers are indeed required to withhold federal, FICA, and Medicare taxes from their employees. They're subject to penalties and all sorts of nastinesses if they don't. See IRS Publication 15-A for details.

There are also tests for independent contractor status; an employer can't simply say, "Oh, you're a contractor, we don't pay your taxes, you deal with that." No, there's a test for this status as well, and again, employers who mis-report employee status are subject to penalties, back taxes, etc., etc., etc....

Social Security is definitely a requirement. The only way you get out of paying that is if you are a minister of a church recognized by the IRS.

Nope, there's definitely something shady going on, if they didn't ask her for her SSN. And there are other forms that were not filled out as well, that have nothing to do with taxes - I9, primarily.

Hey!! What's wrong with day labor tomato pickers?  They need to get paid to break their backs, too.  Sounds like your "boss" is pretending his "employees" are independent contractors, to skirt Soc. Sec. and payroll taxes.  Creative accounting, as practiced by the Bush Administration.  Even so, I'd bet the IRS would like to hear about this clinic's business practices.

Ok, folks.  I got my check today.  I'd spoken to Doc's wife in mid-chaos and said, "YO!!  Kim!!!  I want my check and I have got to talk to you before you leave today!!!"  Then I got slammed with 2 emergencies and a person who wanted me to diagnose a lump on her dog over the phone.

By the time I went to punch out (and sit and wait to talk to Kim) my check was paper-clipped to my time card and Kim was nowhere in sight. 

That's ok....there is always tomorrow.  Or the next day, or the one after that.  I'll catch her and she will have some questions she might not like having asked of her.
