E-Bay I believe this is going to open up a massive law suit against E-Bay. Too many fakes on E-Bay. But is E-Bay responsible for the fakes? Opinions?

shimmy wrote: E-Bay Seems like E-bay is being made the scapegoat here because it is billionaire giant. I don't usually shop E-bay, but out of curiosity I have looked on E-bay at some of the merchandise offered by "individual sellers". Sellers that I believe pay a fee to (like rent) E-bay so they can display their wares on E-bay! I believe there is also an E-bay disclamer, saying that any merchandise offered by the "individual sellers" is not authenticated by E-bay! IMO, it is the "individual sellers", (who are not billionaires, that's why they are not the ones being sued) are the ones who should be sued for faulse advertisements, not E-bay! What's next, are they going to sue "news papers" for "individual seller's" ads they run, and it turns out that the merchandise offered -advertised was somehow faulty! If ebay continually protects their precious PowerSellers that are know to be scammers* and does nothing to stop them, yes, ebay does have at least some responsibility when people get burned. * Please note, I'm not insinuating all PowerSellers are scammers.

I agree with Smitty. Ebay doesn't have any responsibility for a one-off listing of a counterfeit item, but they do have a responsibility to take action if they become aware of a counterfeit item being sold as real, or if they become aware of a seller who consistently sells fakes. Not only that, but there are coins and notes on Ebay clearly sold as counterfeit, which is, I believe, technically illegal. (What's to stop someone from buying one of these counterfeits and relisting it on Ebay (or anywhere else) as real?)

Craigslist openly hosts prostitution ads and lists them as erotic services, so there's no doubt what the "buyer" is getting. It's as if you had a newspaper and had a classified section marked "Cocaine for sale". How could that possibly be legal?
