Just because your relatives are distanced by millions of years, doesn't make it right to disrespect them. That is a good basis for all animal rights (except steak, which I love). YOU THINK ABOUT THAT, BUDDY.

Lower primates aren't capable of having human rights. Exercising human rights necessitates a level of thinking that they haven't attained yet. There's a certain subset of rights which they can exercise (e.g., you could grant them the right to have their interests represented in court, the same way you would for any human infant) but any right stronger than that would be folly, and do more harm than good. Give it a couple hundred thousand years, then check again. Maybe they'll've caught up, or we'll've devolved to their level.

Giving apes human rights (beyond perhaps having a counsel to represent their interests) would be like giving a 5 year old a platinum credit card. (I personally believe they can, but there are researchers who doubt the methodologies involved.) Certainly, they use tools, but lots of animals use tools. That's not a distinction, IMO. Jealousy, sadness, and worry, are also not uncommon in the animal kingdom. The reason you don't give apes human rights is because apes don't have the same cognition as humans. They might merit their own set of rights, but they're not human. A lot of human rights involve communication. Apes are simply not capable of this kind of communication. (Even the signing apes are limited to very simple forms of communication -- mostly requests for food or toys, etc.)
