WASHINGTON (CNN) -- The Supreme Court ruled Wednesday that executing a Louisiana child rapist would be unconstitutional, concluding capital punishment is reserved for murderers.





Patrick Kennedy, 43, was on Louisiana's death row for raping his 8-year-old stepdaughter.


The ruling stemmed from the case of Patrick Kennedy, who was sentenced to death in 2003 for raping his 8-year-old stepdaughter.

The ruling was a 5-4 decision.

I need someone to explain this line to me:

"Difficulties in administering the penalty to ensure its arbitrary and capricious application require adherence to a rule reserving its use, at this stage of evolving standards and in cases of crimes against individuals, for crimes that take the life of the victim," Anthony Kennedy wrote in Wednesday's majority opinion.

Somebody correct me if I'm off base here, but I thought the court wanted to eliminate its arbitrary and capricious application.   Now we're trying to ensure it?!  :wtf:
