Mark Dean Schwab (born December 16, 1968) is a prisoner in the state of Florida, where he is awaiting execution for the rape and murder of eleven-year-old Junny Rios-Martinez, Jr., on April 18, 1991. He was convicted of the crime in 1992, and sentenced to death, in addition to two life sentences. Schwab had been released on March 4, 1991, after only three years for an aggravated rape committed in 1987, for which he was sentenced to 8 years in prison. The remainder of his sentence was commuted, and he was placed on 15 years of probation. A month later, Cocoa resident Junny Rios-Martinez, Jr., turned up missing. Schwab had seen Junny's picture in a newspaper and began to get friendly with Junny and his family, misrepresenting himself as a representative of an unknown surfing competition. On April 18, friends saw Junny get into a U-Haul truck. On April 20, Schwab called his aunt in Ohio, claiming a man named "Donald" forced him to kidnap and rape Junny, under threat of killing Junny's mother, Vicki Rios-Martinez. The next day, police tapped a phone call with Schwab's aunt's permission, and found out where Schwab was located. Schwab was arrested, and led police to Junny's dead body, found in Canaveral Groves, a rural area of Brevard County, Florida in a footlocker that was not completely shut and wrapped in rope. On May 15, 1991, Schwab appeared in a state court in Brevard County, Florida, where he pled not guilty to charges of First-Degree Murder, Kidnapping a Child Under Age 13 and Sexual Assault of a Child Under Age 13. Schwab waved his right to a jury trial, and was convicted the next year, on May 22, 1992. On July 1, he was sentenced to death for the murder, and two life sentences for the kidnapping and rape. In addition, his probation was revoked on the previous rape conviction, and he was re-sentenced to an additional life sentence. The case led to the passage of the "Junny Rios-Martinez, Jr., Act of 1992", which prohibited those convicted of sexual battery from receiving early release in the state of Florida. Repeated appeals have been denied, including the most recent, to the Eleventh Circuit Court of Appeals, on June 15, 2006. In 1997, he served a six-month "institutional adjustment" for a positive drug test. He has been at the Union Correctional Institution in Starke, Florida, since his sentencing. Once his death warrant is signed, he will be transferred to Florida State Prison next door, where the state's only death chamber exists.

You'd probably find out just as much about his brain from the autopsy as you would if you let him breathe the same air as the rest of us.

Well there will be a lot more coming up the pike, so if I were a judge, I'd be telling attorneys they better be asking for the studying "UP FRONT"! I'd also be telling them it would only prolong any Death Sentance by one year!!

This really ticks me off, study what that he is a repeat sex offender that rapes and kills children. The majority of people in the mental health field will tell you the exact same thing these sick freaks can't be cured end of subject. Kill him the sooner the better Like LC said they have had 15 years to study this beast. Sorry Mr. Schwab your days are numbered bye bye..

Charlie Crist on Wednesday signed his first death warrant since taking office in January, ending a temporary halt on lethal injections that was imposed because of a botched execution last year. Mark Dean Schwab, 38, is scheduled to be executed Nov. 15, Crist said. Schwab was sentenced to death in 1992 for the kidnapping, rape and murder of 11-year-old Junny Rios-Martinez of Cocoa. He targeted the boy after seeing his picture in a newspaper. In December, then-Gov. Jeb Bush suspended all Florida executions after a medical examiner said that prison officials botched the insertion of the needles when convicted killer Angel Diaz was put to death. Since then the state has adopted the recommendations of a panel to make the process work better. In signing the warrant on Wednesday, Crist said he is confident lethal injections can proceed in line with constitutional bans on cruel and unusual punishment. Schwab's lawyer recently argued his client's life should be spared so psychologists can study him to better understand pedophiles and prevent them from raping and killing children. Schwab saw the boy's picture in a newspaper after being released from prison in March 1991 for serving three years on sexual assault charges. Schwab called the family on the phone, claiming he was writing an article on the boy. Schwab became friendly with the family, even promising to help the boy get a contract to represent a surfing company. The boy's body was found three days after the murder.

Good to hear he's getting executed. It's a shame he won't get what he deserves, though. That probhibition against cruel and unusual punishment is certainly a double-edged sword.

Charlie Crist has signed his first death warrant, seven months after Florida halted executions and changed protocols to prevent botched lethal injections. Crist said in a written statement he was confident that killer Mark Dean Schwab's execution on Nov. 15 will be consistent with the U.S. Constitution's ban on cruel and unusual punishment. Schwab has been on Death Row since his 1992 conviction for raping and asphyxiating 11-year-old Junny Rios-Martinez of Cocoa. At the time of the killing, he had just been released early from prison for raping a 13-year-old Merritt Island boy. ''It is impossible for this court to contemplate another crime that would be more heinous, atrocious and cruel than the death of Junny Rios-Martinez,'' Brevard Circuit Judge Edward J. Richardson ruled in July 1992. ''The facts show the defendant is a mentally disordered sex offender. He is antisocial and dangerous to male children,'' the judge wrote. Schwab's pending execution is sure to reignite the controversy over lethal injections that was sparked last December when an executioner improperly inserted hypodermic needles into the arms of Miami killer Angel Nieves Diaz. He took 34 minutes to die. Then-Gov. Jeb Bush halted executions and impaneled a committee to oversee the methods of execution. The committee suggested that the state consider reviewing the three-drug cocktail used to kill killers, but Crist ignored the recommendation because prison chief Jim McDonough said the lethal drugs were fine. Crist, though, approved of the recommendation providing more lethal-injection training for prison staff, increasing the size of the execution chamber, beefing up the staff to oversee the process and installing a closed-circuit television monitor to better keep track of executions.
